Yes, that's definitely a state-by-state thing (we don't have it in Florida).

The most common explanation I've heard for the law is to avoid "creating orphans"... which seems to be more of a sentimental wish on the part of detached lawmakers than something of real substance.

I have wondered if it helps motivate agencies to find adoptive homes and/or speeds up the process, but I have not seen statistical information on the actual effects.
