Hugo Chavez sends solidarity to Brazil's Silva

(AP) ? Venezuelan President Hugo Chavez has sent a message of solidarity to former Brazilan leader Luiz Inacio Lula da Silva.

Chavez says he understands the difficult situation Silva is facing after a cancerous tumor was detected in his larynx on Saturday.

Chavez says he's recovering from doctors' removal of a cancerous tumor from his pelvic region in June and his four rounds of chemotherapy.

Silva is expected to begin chemotherapy soon.

Chavez sent his message to Silva on Sunday wishing for his quick recovery.

Greece gambles on referendum for new debt deal (AP)

ATHENS, Greece ? Taking a huge political gamble, Greece's prime minister announced Monday that his debt-strapped country will hold a referendum on the new European debt deal reached last week ? the first such vote in 37 years.

Prime Minister George Papandreou appeared to take many lawmakers by surprise by saying that a hard-bargained agreement that took months for Europe's leaders to hammer out will be put to a public ballot.

He gave no date or other details on the proposed referendum, which would be the first in Greece since 1974, when the monarchy was abolished by a landslide vote months after the collapse of a military dictatorship.

"This will be the referendum: The citizen will be called upon to say a big 'yes' or a big 'no' to the new loan arrangement," Papandreou told Socialist members of parliament. "This is a supreme act of democracy and of patriotism for the people to make their own decision ... We have a duty to promote the role and the responsibility of the citizen."

The move allows Socialist lawmakers ? who have been vilified by an increasingly hostile public during months of strikes, sit-ins and violent protests over rounds of austerity measures ? to pass the responsibility for the country's fate to the Greek people themselves.

Finance Minister Evangelos Venizelos, a constitutional law professor, said the referendum was called after opposition parties repeatedly failed to side with the government in negotiations between Greece and other eurozone members.

"Greece is living through a drama, from which it must be released by asking the people to express its will," Venizelos told parliament.

"Each citizen will make his own decision, with responsibility, in a process that will provide a national sense of relief and recovery."

Later he told private Antenna television: "It is very clear: The new agreement will be submitted to parliament for approval and then submitted to the judgment of the Greek people ... the Greek people can of course say 'no' but must bear in mind the consequences of that decision."

Venizelos indicated the referendum would be held early next year, after weeks of complex negotiations to finalize details of the new agreement.

The new debt deal aims to seek 50 percent losses for private holders of Greek bonds and provide the troubled eurozone member with euro100 billion ($140 billion) in additional rescue loans.

Papandreou's government has seen its majority reduced to just three seats in parliament and its approval ratings plummet amid harsh austerity measures that are sending the country into a fourth year of recession in 2012.

The EU statistics agency Eurostat estimated in a report issued Monday that unemployment in Greece reached 17.6 percent in July ? even higher than the Greek estimate for that month of 16.5 percent.

"This is just the latest twist in the unfolding Greek tragedy," said Sony Kapoor, managing director of Re-Define, a London-based think tank.

"With an irresponsible opposition that is promising Greek voters the moon, it is very difficult to see how this referendum could be won under the ongoing gut-wrenching austerity."

There was no immediate reaction from leaders of eurozone countries, who struggled for months to overcome their differences before reaching the Oct. 26 agreement ? the second broad agreement reached in four months.

British Foreign Secretary William Hague said the referendum was "a matter for the Greeks."

"Every country needs to have their own domestic political approach to the problems ... The consequences of a 'yes' or 'no' vote are something that will have to be debated in Greece," Hague told Channel 4 News.

"We look to all the countries in the eurozone to honor the agreements they have entered into."

In Greece, opposition parties accused the government of calling the vote to save its teetering government, threatened by growing dissent from Socialist dissenters.

"The prime minister is trying to buy time," said Costas Gioulekas of the conservative New Democracy party said. "We want clear solutions. And a clear solution is obvious: Elections."

Under Greece's constitution, a referendum requires approval by parliament before it is officially declared by the country's president. Gioulekas would not say whether his party would back a "yes" vote.

Support for the Socialists has eroded so much that anti-government protesters forced authorities Friday to cancel an annual military parade to honor World War II veterans, causing deep embarrassment to the government.

MF Global files for bankruptcy after deal unravels (Reuters)

NEW YORK (Reuters) ? MF Global Holdings Ltd filed for bankruptcy protection after a tentative deal with a buyer fell apart, marking a stunning failure for CEO Jon Corzine who tried to turn the more than 200-year-old futures brokerage into a mini-Goldman Sachs.

The meltdown made MF Global the biggest U.S. casualty of the European debt crisis, as the brokerage paid the price for the former Goldman CEO's big, risky bets on sovereign debt.

The Chapter 11 bankruptcy filing came after talks to sell a variety of assets to Interactive Brokers Group Inc broke down earlier on Monday, a person familiar with the matter said.

MF Global's collapse has raised questions about whether the 64-year-old Corzine's affinity for risk-taking finally caught up to him after a career that took him to the top echelons of Wall Street and then into politics as a U.S. senator and to the New Jersey state governor's mansion.

The bankruptcy, the seventh-largest by assets in U.S. history, is reminiscent of 2008 when Lehman Brothers collapsed at the height of the financial crisis. But market participants said the impact from this collapse, far smaller, would likely be contained.

MF Global traders and counterparties were left scrambling and confused on Monday, as MF Global halted its shares, but did not file for bankruptcy until well after the U.S. markets had opened.

"Ultimately it will have lost all confidence of its investor base," said Michael Epstein, a restructuring adviser with CRG Partners. "I'm not sure what restructuring it actually does. In some respects, it's a baby Lehman, in effect."

Three traders wearing MF Global jackets were seen leaving the Chicago Board of Trade prior to the opening of pit trading and floor sources told Reuters they had been turned away after their security access cards were denied.

The New York Federal Reserve suspended MF Global from conducting new business with the central bank. CME Group Inc, IntercontinentalExchange Inc and Singapore Exchange Ltd and Singapore's central bank all halted the broker's operations in some form except for liquidations.

There was little evidence of any severe ruptures in commodity markets, although volumes were down sharply as investors said they preferred to wait for more clarity before placing new trades.

JPMorgan Chase & Co's exposure for a $1.2 billion syndicated loan to MF Global is less than $100 million, a source at the bank said.

Jeff carter, an independent futures trader in Chicago, said the impact on the markets should be smaller and nothing like when Lehman failed and hedge funds had money locked up with the firm for months.

Corzine's decision to chase yield by going after European sovereign debt was clearly ill-advised and always seemed much too risky, Carter said.

On Monday, MF Global's HR department was busy making calls withdrawing job offers it made over the past few weeks, according to a person familiar with the situation.

BANKRUPTCY FILING

MF Global scrambled through the weekend and into Monday to find buyers for all or parts of the company, while at the same time hiring restructuring and bankruptcy advisers in case nothing could be done.

The company's shares and bonds plunged in recent days. In the past week, MF Global posted a quarterly loss, its shares fell by two-thirds and its credit ratings were cut to junk.

Corzine was trying to transform MF Global from a brokerage that mainly places customers' trades on exchanges into an investment bank that bets with its own capital.

But the company was also suffering because of low interest rates, which hurt profits from core brokerage operations.

It may be easier for MF Global to work out a sale in bankruptcy than outside of it, said Bill Brandt, chief executive of Chicago-based turnaround firm Development Specialists Inc.

By filing for bankruptcy, MF Global freezes the value of its free-falling notes and gives potential suitors a clearer picture of the losses they would be taking on, Brandt said.

"If I were trying to do a deal fast, rather than sell the company itself, I'd see if I could peg the notes at a discounted price and find someone else to buy the distressed notes," Brandt said.

If a sale is in the offing, the buyer may be a European bank or sovereign government, as such entities would be particularly keen on stopping the slide and maximizing the value of the notes, Brandt said.

MF Global Finance USA Inc also filed for Chapter 11 protection, court records show. Both MF Global entities filed for protection from creditors with the U.S. bankruptcy court in Manhattan.

"The real question is how many assets will be left to transfer," said Niamh Alexander, an analyst at Keefe, Bruyette & Woods.

"Customers might move very quickly and it may be that every hour that passes shrinks the portfolio of assets that could be transferred" to a buyer, KBW's Alexander said.

MF Global's deeply distressed 6.25 percent notes maturing in 2016 fell 10.5 cents on the dollar to 39.5 cents, pushing their yield up to 31.6 percent, according to the Trace, which reports bond trades. The price had earlier fallen as low as 15 cents.

Its shares remained halted in New York.

The company hired boutique investment bank Evercore Partners Inc to help find a buyer, separate sources said this past week.

Crosses on public land: Did Supreme Court leave legal issue in 'shambles'?

The Supreme Court agrees not to take a case on whether memorial crosses on public land in Utah violate the First Amendment. But one justice says the court has left the topic in legal limbo.

The US Supreme Court on Monday rejected a request to take up two cases examining whether officials in Utah violated the separation of church and state when they authorized the placement of 13 white crosses on public roadsides and other property as memorials to fallen state troopers.

The court's rejection of the case leaves in place a circuit court ruling that would require the removal or dismantling of the crosses.

The cases raised an issue that has sharply divided the high court in recent years: When does the display of a religious symbol on public land violate the First Amendment?s ban on government establishment of religion.

Utah officials had urged the justices to use the case to identify a new legal framework to decide disputes involving displays on public property featuring crosses, the Ten Commandments, holiday cr?ches, menorahs, and signs with religious or quasi-religious messages.

Apparently, the only justice willing to take up that project was Clarence Thomas, who issued a 19-page dissent to the high court?s refusal to hear the Utah cross cases.

?Today, the court rejects an opportunity to provide clarity to an establishment clause jurisprudence in shambles,? Justice Thomas wrote.

He said the Supreme Court?s approach to such cases ?has confounded the lower courts and rendered the constitutionality of displays of religious imagery on government property anyone?s guess.?

In the Utah cases, each cross was erected close to the place where a trooper was killed. The 12-foot-tall cross memorial includes the name, rank, and badge number of the deceased officer, the year the trooper died, and the highway patrol?s official logo. The memorials also include a plaque with a photo and biographical text.

Officials said the memorial crosses were intended to communicate a combined message of ?death, honor, remembrance, gratitude, sacrifice, and safety.?

The crosses were donated by the Utah Highway Patrol Association, a private organization. No state funding was used to design or erect the memorials, and state officials expressed no position on which symbol should be used for the memorials.

In each case, a cross had been selected by the fallen trooper?s family as an appropriate symbol for that trooper?s memorial.

A Texas-based group, American Atheists, filed suit challenging the placement of the crosses on public land. The group said the crosses demonstrated a state preference for the Christian religion and amounted to an official endorsement of Christianity.

State officials and the Utah Highway Patrol Association defended the use of the cross for the memorials, saying the cross is a recognized symbol of death, not an endorsement of a particular faith.

A federal judge agreed and dismissed the suit. The Denver-based 10th US Circuit Court of Appeals reversed.

?We conclude that the cross memorials would convey to a reasonable observer that the state of Utah is endorsing Christianity. The memorials use the preeminent symbol of Christianity,? wrote Senior Circuit Judge David Ebel for the unanimous three-judge panel.

The people spoke and Lindsay Lohan listened! Lohan took her yellowed teeth to celeb-friendly cosmetic dentist Dr. Bill Dorfman, who whitened her smile.

"Thanks Dr. Dorfman for the zoom," Lohan tweeted, and posted a picture of her new look to her WhoSay page. "My gums are so sore though!"

Most recently, Lohan's dental upkeep hasn't ranked among her biggest problems; Lohan's probation was revoked during an Oct. 20 court appearance, and she's due back to stand before Judge Stephanie Sautner on Tuesday.
